In 2020, Colorado voters approved a program providing universal preschool funding to families across the state. Participating providers must agree to nondiscrimination requirements ensuring children have an equal opportunity to enroll regardless of characteristics including sexual orientation and gender identity.  

Two Catholic preschools declined to sign the agreement, arguing that the requirement conflicted with their religious beliefs, and sued alongside two parents and the Archdiocese of Denver after being excluded from the program. Lower courts upheld the requirement, but the U.S. Supreme Court agreed to hear the case and is scheduled to hear oral arguments on November 3, 2026.
