Mahmoud v. Taylor (2025)
In Mahmoud v. Taylor, the Supreme Court ruled 6–3 that Montgomery County Public Schools’ decision to eliminate religious opt-outs for lessons involving LGBTQ+-inclusive books likely burdened parents First Amendment right to freely exercise their religion. The decision requires the district to provide notice and allow parents to opt their children out of instruction involving the books while the case proceeds.
The ruling has the possibility of creating consequences far beyond Montgomery County, potentially encouraging religious objections to a much broader range of public-school curriculum and placing new burdens on teachers and schools to anticipate which lessons might conflict with families’ religious beliefs. The dissent warned that the decision could also undermine students’ own ability to encounter different perspectives and exercise their developing freedom of conscience.
